Kyrgyzstan, the State Committee for National Security detained Chechen activist Mansur Movlaev. On Monday, the Pervomaisky District Court of Bishkek chose a measure of restraint – until October 20, Movlaev will be in custody.
Mansur Movlayev was detained in the village of Bosteri in the Issyk-Kul region, his lawyer Bakyt Avtandil told RFI. According to him, while the detainee was being taken to Bishkek, he was beaten every ten minutes, but Movlaev did not complain about the ill-treatment at the trial. The director of the National Center against Torture in Kyrgyzstan, Bakyt Ryspekov, also said that the staff of the center visited the detainee and that “there were no complaints from him about the use of torture.” During the examination, bruises on the forearms and an abrasion on the knee, received during the detention, were noticed. This information was given to RFI by the President of the human rights organization “Bir Duino Kyrgyzstan” Tolekan Ismailova.
A criminal case was initiated against Movlaev under article 378 of the Criminal Code of the Kyrgyz Republic “Illegal crossing of the state border”. In two months, the investigation hopes to establish the identity of the defendant – Movlaev has no passport, no address in Kyrgyzstan, no registration. Under the sane article, he faces a fine or imprisonment for up to two years.
The note to Article 378 states that “This article does not apply to cases of arrival of foreign citizens and stateless persons to exercise the right of asylum. Movlaev’s defense intends to seek the status of an asylum seeker.
A Chechen activist who criticized Ramzan Kadyrov, Mansur Movlaev (28 years old), was convicted in Russia in a drug case in 2020. In 2022, he was released on parole, but then re-detained in Chechnya by officers of the Shalinsky District Department of Internal Affairs. According to the BBC, referring to the Chechen oppositionists Ibragim and Baisangur Yangulbaev, Movlaev was going to move from Kyrgyzstan to Europe: “He was supposed to fly from Kyrgyzstan to Turkey. We have already discussed with international human rights activists how to grant him political asylum in Europe.”
Movlaev is on the interstate wanted list “for adherence to radical ideology. Human rights activists fear his deportation to Russia. “He might just be killed there,” Tolekan Ismailova said of human rights activists’ concerns.
According to Bakyt Avtandil, “there is no request for extradition yet.” However, there is an “Agreement on Legal Assistance” between Kyrgyzstan and the Russian Federation. And on June 21, Kazakhstan, Kyrgyzstan and Russia ratified the Agreement on Mutual Legal Assistance in Administrative Matters in the Sphere of Personal Data Exchange.
