On August 30, the Supreme Court annulled the decisions of the district and city courts against the son of Askar Kubanychbek, who was convicted of participating in the war in Ukraine, and sent the criminal case for reconsideration. This was reported by the press service of the institution. Thus, the request of the lawyer was partially satisfied. Now this case will be reviewed by a new court.
On May 16, 2023, the First May District Court of Bishkek sentenced the son of Askar Kubanychbek, who was accused of participating in the war in Ukraine as part of the Russian forces, to 10 years.
The Bishkek City Court, which considered the appeal, upheld the same decision on June 7. This was the first time that Kyrgyzstan was punished for its involvement in the war in Ukraine.
Askar Kubanychbek uulu, a Kyrgyz citizen living in Moscow, joined one of the Russian military groups and participated in the war in Ukraine in June 2022 “for financial gain”.
Before this, Kirill Kabanov, a member of the Human Rights Council of the Russian President, announced that he would appeal to the Kyrgyz authorities to request the release of Askar Kubanychbek, a Kyrgyz citizen who participated in the war in Ukraine and was arrested in Bishkek.
After that, the representative of the Ministry of Foreign Affairs of Russia, Maria Zakharova, said that the issue of giving a Russian passport to Askar Kubanychbek’s son is under consideration.
Official Bishkek did not respond to this statement. “Azattyk” turned to the Ministry of Foreign Affairs with a request for relevant information.
Kyrgyz analysts consider the attempt to extradite a citizen convicted of “mercenary” to Russia as interference in the internal affairs of Kyrgyzstan.
Recently, another Kyrgyz citizen, Beknazar Borygul, was found to have participated in the war in Ukraine and was arrested. A 27-year-old resident of Naryn was arrested by the State Committee for National Security on August 1 as a suspect for recruitment. It was found that he took part in the war in Ukraine as a member of the “Wagner” private military company from his prison in Russia and returned to his hometown on July 8.
Kyrgyzstan warns that its citizens will be held criminally liable if they participate in an armed conflict on the territory of a foreign country.
